What is CASp and how can it help my business?
California created the CERTIFIED ACCESS SPECIALIST program (CASp) to test the knowledge of and certify ADA Access Compliance inspectors. CASp is only applicable to California law. Alberto Rubio, Principal at ARS Access Consulting llc is Licensed by the state of California as CASp #991. After completing an inspection with ARS Access Consulting, you will receive your CASp report. CASP reports permit businesses to benefit from a 90-day stay or halt to any pending litigation that prevents attorneys from pursuing motions, discovery, or other actions that will compound their legal costs.
Why do I need to worry abut ADA code compliance?
The main benefit of being ADA compliant is it will decrease the risk of lawsuits against your business. Being proactive about changes for ADA compliance can save you money. Unfortunately, people seem to be more litigious than ever and its not difficult to file time consuming & costly lawsuits for minor violations. Also, its just good business practice. If customers can’t easily get to you, they just won’t buy from you.
Is there a difference between State and Federal Laws?
In fact, there is a difference between the ADA laws of states and the ADA laws of the federal government. It is possible to comply with federal laws but still be sued for noncompliance with state laws if they differ. Therefore, it is best to use a CASp inspection report.
Who is responsible for fixing the handrails and bathrooms in my building?
Building owners are generally responsible for ADA compliance on the exterior. Business owners are generally responsible for interior ADA compliance. There are some exceptions to this that we would be pleased to discuss with you. Business owners can ensure they are held harmless in the event that a building owner fails to comply with ADA laws due to not upgrading the exterior accessibility.
